This memorandum of agreements entered into on December 29, 2007, by and between:
The PULLTRAVEL DESTINATION CORPORATION (P.D.C.) A CORPORATION duly organized and existing under by the virtue of the laws and the Philippines and officially engage in the business in promoting and developing tourism projects particularly in Barangay Sta. Juliana Capas Tarlac Philippines, hereinafter referred to as the FIRST PARTY:

The CAPAS PINATUBO 4 WHEELERS ASSOCIATION located at Brgy. Sta Juliana Capas Tarlac, represented by MR.JUDE LENNON and the 4x4 officers, hereinafter represented as SECOND PARTY.
WITNESSETH; that:
WHEREAS the FIRST PARTY desired to promote and developed the MT. Pinatubo crater in Botolan Zambales and Hot Spring as a major tourist attraction via Sta.Juliana Capas Tarlac as their gateway to their main destination
WHEREAS the FIRST PARTY desires to seek authority from the SECOND PARTY to establish tourist related facilities in Sta. Juliana Capas as part of the over all program to induce travel, tourism and employment to the community which includes though not limited to 150 capacity dining facility, health fitness center, grille, SPA, and reservoir, administration office, among others.
WHEREAS the SECOND PARTY will depart and return back the tourist guest at P.D.C (Pull Travel Destination Corporation) SPA town.
WHEREAS the SECOND PARTY maintain and check their 4x4 vehicle conditions, to be road worthy every time they are rented by the SPA. 4x4 must provide seat belt, foam protection and the driver must be presentable and clean.
WHEREAS the SECOND PARTY will give discounts on rental fee for those Ocular inspection guests, Promotion media, student, Missionaries, Relief ect, Government agency, D.O.T. trip (20% discounts.)But depends on their purpose, they are not tourist guest.
NOTE: NO C.F. deductions and NO jeep donation

Now therefore and in consideration of the above cited premises and mutual covenants herein contained, the parties do hereby bind themselves and agree on the following.
1. All members must submit a Xerox copy of 4x4 registration and drivers license "No license No trip "Operators membership certification.
2. Drivers must have the knowledge that the prices is very sensitive and Confidential do not inform any THIRD PARTY (guest) about the prize.Guest should be inform for the additional fees for additional side trip (Hot Spring)
3.4x4 drivers must put enough diesels to avoid shortage, make sure that the 4x4 use is in good condition to avoid accident and delayed trips.
4. Must have at least 3 4x4 reserve/stand by in order that if there is unexpected guest there is available vehicle ready to depart.
5.4x4 drivers are prohibited from acting as agents offering lower charges to the customer.
6.4x4 drivers can not imposed unilateral decision with out consultation of all parties involved in the operation.
7.4x4 vehicles registration must include the proper insurance.
8. It is the responsibility of the SECOND PARTY to dispatch an immediate rescue vehicle team to attend any incident, accidents
9. P.D.C. (Pull Travel Destination Corporation) in the consultation with the SECOND PARTY has the right to suggest and recommend a certain suspension for the 4x4 drivers. But if the 4x4 Association doesn't have any action regarding the complain letter the P.D.C. have the authority to suspend the 4x4 driver.
10. During the deliberations of both parties was agreed if any officer and members of the 4x4 Association violated the MOA the action will be return to the previous 4x4 rental fee rates.
11.That all 4x4 driver must know that P.D.C. was authorized and accredited to offer tour packages and obtained tour bookings of Local, International guest and, Travel agencies that the 4x4 drivers can not personally cater and contact directly to the guest.
12.4x4 Association are allowed to have personal/direct guest to cater as long as they register at P.D.C. provided that the foreigner will be book in package rates upon registration as per agreed by both parties.
The Parties have agreed to enforce a trip to the areas of Mt. Pinatubo via 4x4 with corresponding charges to the FIRST PARTY by the SECOND PARTY per destination herein described below.

No transfer of assignment of rights shall be allowed either by way of mortgaged, hypothecation, or any other manner or scheme that may alienate or prejudice the rights of the SECOND PARTY.
All memorandum of Agreement agreed by both parties, if there is violation on both parties the Municipal tourism headed by MAYOR REYNALDO CATACUTAN has the right to interfere and make an action.
IN WITNESS WHER OF, the parties have hereunto set their hands at the place in Brgy. Sta Juliana Capas Tarlac, PHILIPPINES this 30th day of December 2007.
