STA. MARIA VILLAGE TENNIS CLUB

Agreement on Rules and Regulations Governing the Use of SMV Tennis Court

The Sta. Maria Village Association, Inc. hereby grants permit to the duly-organized and recognized SMV Tennis Club to manage and operate the tennis court effective this date subject to strict compliance with the following rules and regulations:

MANAGEMENT

It shall be the responsibility of the members to cover the cost of construction and maintenance of any infrastructure facilities which the club may deem necessary. Special privileges or consideration to the club may be granted by SMVA to recoup its initial investments in restoring the facility back to its playing status.

It shall be the responsibility of the club to ensure that their members maintain good behaviour and right conduct while in and around the vicinity of the open space with due consideration to maintenance of the peace and quiet in the neighbourhood and seeking to avoid conduct unbecoming of a good gentleman and member in good standing. Loud, boisterous, profane language, or excessive intake of alcoholic beverages or prohibited drugs including illegal gambling and other activities, both on and off the court, shall be strictly prohibited.

It shall be the responsibility of the club to suspend or terminate the membership of a member who has been found to behave in a manner incompatible or disagreeable to the other members as determined by the club and to the community in general as determined by the Sta. Maria Village Association, Inc. SMVA reserves the right to impose sanction/s on any member or guest who is found to behave in a manner detrimental to the interest of the community of this village.

The tennis club facilities and services shall be open daily from 6:00 a.m. up to 8:00 p.m. Extension of time of stay at the club beyond this time may be permitted upon approval from SMVA and subject to provision of Art. I, Sec. 3 herein. No person may enter or remain inside the club premises beyond closing hours without seeking permission from SMVA.

The tennis club may conduct special events or tournaments on special occasions provided that prior written permit is secured from SMVA and provided further that herein pertinent provisions relating to good behaviour and right conduct be observed at all times.

The management and supervision of the tennis court is bestowed upon the authority of the tennis club as a matter of privilege and is subject to revocation or suspension whenever SMVA deems it lawful and necessary to protect the interest and general welfare of the homeowners.

The club shall endeavour to enlist the services of an administrative staff to handle the day-to-day operation of its activities. It shall cease and desist from employing the services of the SMVA staff for its administrative functions.

SAFETY AND SECURITY

It shall be the responsibility of the club to ensure that safety and security within the community be preserved at all times by conducting diligent screening of applicants for membership. Only those applicants of good moral character shall be admitted to the club roster.

To maintain an environment of peace and security at all times, club members and their guests shall be required to secure car stickers on an annual basis and to pay the corresponding fees thereof. If not, they shall be required to surrender their identification card upon entry at the main gate. The club shall submit the updated list of its regular members to SMVA on a monthly basis for reference purposes.

It shall be the responsibility of the club to ensure a gun-free community and thus, shall prohibit carrying of gun/s while in and off the court premises.

It shall be the duty of the club officials to police their own ranks at all times.

COLLECTION OF USER / MANAGEMENT FEES

SMVA hereby reserves the right to collect regular monthly management fees from the club as token for its use of the area the rate of which shall be subject to mutual agreement of both parties herein.

Failure to remit payment for such fees - within three (3) consecutive months - as may be imposed by the association may result in the cancellation or revocation of this agreement even without regard to due notice to comply and shall be subject to sanction/s the nature of which shall be determined by SMVA.

The club maintains a policy of first-come-first-served basis when it comes to playing rights. Homeowners are required therefore to follow the same procedure if they wish to play. Homeowners shall be entitled to discounted privileges or concessions on the collection of membership fees (one-time fee only). Homeowners are required to pay the regular fees such as per-game and ball-boy fees.

MISCELLANEOUS ITEMS

Vendors or concessionaires selling items like refreshments and snack food at the club premises are prohibited unless specifically permitted in writing by SMVA.

Parking of motor vehicles shall be allowed only in designated areas at the open space. The use of the basketball court as parking is prohibited as the practice encroaches on the right of homeowners to play therein.

SMVA holds no responsibility for any lost valuables or personal articles inside motor vehicles or destruction of any part thereof while parked in the open space. Do not leave valuables unattended.

The members of the club shall undertake to handle the cleanliness and sanitation of the club facilities and equipment at all times. Littering is prohibited. Club members and guests must leave the premises free of litter or debris. The club shall be required to pay its monthly garbage fee the rate of which shall be determined by both parties from time to time.

SMV may, in the interim, issue additional rules and regulations governing the operation of the tennis court as it may deem necessary from time to time.

SUSPENSION, REVOCATION AND CANCELLATION

The permit to use the tennis court as granted to the duly-recognized club – as a matter of privilege - may be suspended, cancelled or revoked by SMVA at any time it deems necessary to protect its right as lawful owner of the facility. The club may appeal the decision of the association within fifteen (15) days upon receipt of a notice of cancellation.

No part of these rules and regulations may be repealed or amended without the mutual consent of both parties.

I hereby certify that the information contained herein is true and correct, and agree by the terms set forth in this Rules & Regulation Governing the Use of the Tennis Court. I understand that failure to do so may lead to the cancellation of the permit to use, manage and operate the tennis court, and other disciplinary actions by the Sta. Maria Village Association, Inc.
